Terms of Service

1. Who we are
Rack ("Rack", "we", "us", "our") is operated by Mason Patrick McCaw (the "Seller"). By using Rack you are contracting with the Seller.
2. Acceptance
By creating an account or continuing to use Rack, you agree to these Terms. If you do not agree, do not use the service.
3. The service
Rack is a personal digital wardrobe that lets you catalog garments, generate AI-assisted descriptions and valuations, build outfits, and (on Pro) receive weather-based outfit suggestions.
4. Your account
You are responsible for keeping your credentials confidential and for all activity under your account. You must provide accurate information and keep it up to date. You must be of legal age in your jurisdiction to enter into this agreement.
5. Acceptable use
You must not:
- use the service unlawfully or to commit fraud, spam, or harassment;
- infringe anyone's intellectual property rights or upload content you do not have the right to use;
- interfere with the security or integrity of the service (malware, probing, scraping, or bypassing rate limits);
- reverse engineer, resell, or redistribute the service;
- upload illegal, harmful, or infringing images.
6. Intellectual property
The Seller retains all right, title, and interest in the service, including software, models, branding, and documentation. You retain ownership of content you upload; you grant us a limited license to host and process that content solely to operate the service. AI-generated outputs (descriptions, valuations, matches) may be inaccurate — verify before relying on them for resale, insurance, or other decisions.
7. Service level
We do not guarantee that the service will be uninterrupted or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
8. Payment and subscriptions
Paid plans are billed monthly or annually in advance and renew automatically until cancelled. Plan changes are prorated immediately. You can cancel at any time; access continues until the end of the current billing period. All payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms and our Refund Policy.
9. Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
10. Suspension and termination
We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated policy violations. On termination, your access ends and stored content may be deleted after a reasonable window.
11. Liability
To the fullest extent permitted by law, our aggregate liability is limited to the fees you paid in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence where such limitation is not permitted by law.
12. Governing law
These Terms are governed by the laws of the Seller's jurisdiction of residence. Disputes will be resolved in the courts of that jurisdiction, unless otherwise required by mandatory local law.
13. Changes
We may update these Terms from time to time. Material changes will be announced in the app or by email. Continued use after changes take effect constitutes acceptance.
